Frank La Fontaine
Frank has acquired valuable litigation experience in a variety of commercial litigation matters before federal, state and administrative courts. He also counsels clients in matters concerning intellectual property, telecommunications, information technology, and privacy law. In addition, Frank frequently advises clients regarding the selection, protection, and enforcement of trademarks and service marks in United States and Puerto Rico.
Mr. La Fontaine has the following published cases: Benítez-Navarro v. González-Aponte, 660 F.Supp.2d 185 (D. Puerto Rico, 2009) (compelling arbitration of an action for purported securities fraud); San Juan Cable LLC d/b/a OneLink Communications v. Puerto Rico Telephone Company, Inc., 623 F.Supp.2d 189, 47 Communications Reg. (P&F) 1353, (D. Puerto Rico, 2009) (holding that cable company lacked standing to enforce federal Cable Act provisions or FCC orders against would-be competitor); Lang v. Corporación de Hoteles, S.A., 522 F. Supp.2d 349 (D. Puerto Rico, 2007) (finding no general jurisdiction over the defendants); Oliva v. Ramírez, 2007 WL 2436305, Civil No. 07-1569-JAG (D. Puerto Rico, 2007) (after evidentiary hearing, entering preliminary injunction against trademark counterfeiter, including order to immediately transfer domain names).
He has represented a leading global IT firm in negotiations for a multi-million dollar hardware sale to a local public utility.
Frank is involved in all aspects of the local phone company’s bid to become the first provider of Internet Protocol Television (IPTV) in Puerto Rico.
He is strongly committed to pro bono work; Frank successfully defended the Puerto Rico Olympic Trust from a land vindication claim that threatened to undermine development of the Olympic Training grounds in Salinas, Puerto Rico. See Compañía Ganadera Cojoba, Inc. v. Comité Olímpico de Puerto Rico, et al., 2009 WL 2482165 (Mar. 25, 2009), cert. denied by the Puerto Rico Supreme Court on Oct. 23, 2009.
He is also a frequent lecturer on internet research strategies.
