Bankruptcy Court Issues General Orders

The Bankruptcy Court for the District of Puerto Rico has issued the following General Orders in light of the Governor’s Executive Order 2020-03 and the COVID-19 national emergency:

General Order 20-03

The Bankruptcy Court will be closed until March 30, 2020. This closing will not affect the court’s electronic filing system and the staff will be working remotely. The automatic stay in all pending motions requesting relief from the stay will remain in full force and effect. In addition, all deadlines set by statute of limitations applicable to causes of actions are extended until April 13, 2020.

General Order 20-04

This General Order modifies temporarily Local Bankruptcy Rule 5005-4(j) regarding the Debtor’s original signatures in documents filed before the Court. Effective March 20, 2020 and until April 13, 2020, electronic filing of a Verified Paper without Debtor’s original signature is permitted, provided that the filing of such document constitutes a certification from debtor’s attorney that, at the time of the filing, the Debtor has signed such document and that counsel is in possession of a signature page received either electronically (including email or text) or by facsimile machine from the Debtor. For the purposes of this order, Verified Paper includes proposed plans of reorganization, schedules and voluntary petitions.
