Preliminary Confirmation Submission and Discovery Procedures for Title III Cases

Four (4) years after the Commonwealth of Puerto Rico filed the petition under Title III of PROMESA, the Court has scheduled the commencement of the plan confirmation process for November 8, 2021.  As part of this process, discovery regarding certain confirmation issues has been allowed and the Court has established a discovery schedule accordingly.

Any creditor or party in interest who wishes to participate in the discovery process, must file a notice of intention to participate in discovery (“Discovery Notice”) on or before August 15, 2021. If the Discovery Notice is timely filed, creditors will have access to an online depository of documents and will be able to also serve discovery requests.

The Discovery Notice must be filed electronically with the Court if the creditor is represented by Counsel. If the creditor is not represented by Counsel, the Discovery Notice must be mailed and received by the August 15, 2021 deadline to the following address: Discovery Notice to the Court’s Clerk’s office, United States District Court, Clerk’s Office, 150 Ave. Carlos Chardón Ste. 150, San Juan, PR 00918-1767.
